MemberPhil,
THANKS… Thanks for clarifying. I am not sure who I talked to exactly but I will dig it up and let you know because the information provided to me was different and conflicting. I contacted your magazine as well as your competitors with the same response. Your response has given me a look. The magazine responses have made my wife hesitant on me changing careers – She is tired of me giving stuff away.
As Zach and some others know, I have been trying to make a change in direction and get back to my roots of Illustration and painting – It has been a one step forward and 2 steps back process because of all the crazy bumps in my road of life. All is well and I keep plugging away (house fires, tornados, babies, illnesses, deaths, a crazy boss

MemberTosh –
First, some great work on your site….not like you need to be told, eh?
kendal larson
MemberGood for you Kevin!
Here’s wishing you huge success.
I’m very pleased with a recent success of my own, and have to share.
I just today came to terms with a photo stock agency in Germany that’s going to market my work in Germany, and then their sister office will be marketing it internationally. I’m very pleased with this, as they’re interested in my nature and outdoor (hunting/fishing) work. As I sell more, it’ll mean more time for me in the field, which I’m ALL about.

MemberThe Disciplinary “write up” is a good thing for me – documentation of me doing the right thing. The job ran over the weekend with stolen material on the brochure. The boss (who is also the owner of the company) pushed it through behind my back.
You would think that he would be grateful that I tried to save him and the client a bunch of headache. His only concern was making money and what he calls customer service (the customer is always right).
I am curious to see how this plays out because the employee that was strong armed into running the job has also contacted Super Stock to cover his back. Now to go to a meeting on how to make this company “GREEN” – this should be fun.
2 quick comments:
– I’d consult an employment attorney. This situation stinks to me.
– I’d be looking for another job. Who wants to work for someone that’s willing to do something knowingly wrong.
I’ve been in your shoes before, and it caused me massive amounts of stress.
Good luck man – and again, good on ya for tryin’ to do the right thing.

MemberI am not an attorney, nor do I play one on TV but… It seems to me that just the act of an employer trying to force you into breaking a law, is breaking a law on its own. Disciplining you for not breaking a law is a new can of worms and probably breaks another law. Make an anonymous call to your District Attorney office and get the actual truth.
Seems to be that your Boss would be grateful to you as you saved them ,yourself and the client a potential law suit. I am sure that the image in question has probably been registered too and if that is the case, you saved everyone a boat load of money from this potential law suit. Protect yourself my friend and protect your job, seek legal advise on what your rights are and how you can best protect yourself. You don’t have to seek legal remedy but at least know what your recourses are.
If it counts: I am very proud of you but at the same time, I hate that you were put in that position.
Ben said it all – especially the last bit.

MemberThis whole subject can go round and round. Basically folks should get paid… taxes for the tax man.
This subject is close to me on many fronts. I purchase images daily and it is a main part of my job.
I was “written up” on Friday for not using a rights managed picasso on a design project we are working on (managed through super stock). We had not paid for it and I was told to use the lo-res off the web. “It is running small – they’ll never know”. I let the client know that I would run the design if the image were paid for and they said that it was not in budget.

MemberAll great responses guys! Thanks. It is really a lot to think about.
What are the going rates for stock photos for something like this from an amateur photographer (me)? How are the prices set? How about for field assignments? I really do appreciate the feedback and from the variety of responses can see that I hit on something interesting.

MemberThis whole Pixel Peeper label, to me (and no offense Kendal), is nonsense.

MemberDo any of you guys know if the companies in our industry (Columbia, Simms, Scientific Anglers, ect.) hire marketing companies to do design/photography for magazine/web advertisements, catalog design, and package design?
kendal larson
MemberYep – same here.
Only small groups of shots, but I’ve left mine on hi ISO settings, either from night before photos, or early, early morning shots.
The good thing is, while I’m not a Pixel Peeper (dood who ALWAYS checks EVERY shot in the lcd to make sure it’s ok) I do manage to catch the basic look of the shot out of the corner of my eye every once in a while (I shoot 50/50 eyes open/eyes shut) so I catch it if the whole shot is blown after a few clicks.
But yeah – we’d ALL been there.
Kendal (….whole set of shots of the Space Shuttle landing at the Paris Air Show – nada – no film – ARGH!)
heh

MemberIt is a stretch to be true – I’m not sure how misleading though – and here’s why I say that; how misleading about quality of imagery can you be as A) fast as that’s blowing by and B) when we’re talking about 72 dpi imagery?
I mean – given the low-res of the presentation, you might be able to push things a lot with a lesser camera, and come close enough that folks out there not in the know wouldn’t know the difference.
That *might* have been their (Canon) rationale.
All that said, I’ve walked the marketing path before, and were it me I’d have been damn sure to have shot it with that new body – I mean, wth – that’s just stupid not to, and not to say “Look how friggin’ cool our camera is – we made this snazzy commercial using it!”
Implying it is less than graceful.

MemberOh – and Dusty – if budget is your issue, you can pick up a used XTi from that place.
$399
Hard to say how many times that shutter’s been released, but still….might be worth pondering.

MemberLol kendal.
Dont hate the player, hate the game. 🙂The 30/40D AF is nice as is the XTs and thats why I hesitate to use words like wanting, but the truth of the matter is more and more I felt like its AI Servo was holding me back. A classic example and it happened many times was being out shooting with some guys who had the MKIIN or MKIII and in the extra split second it took me to get focus acquisition, they were ripping off frames. Even the 1D has limits and I lose focus while in Servo or I dont get it fast enough and miss the opportunity but again, relatively speaking, it less an “issue” as with the 30/40 as with the XT. Because sooooooo much of my wildife/avain shooting is fast paced action thats a big issue. If I was more of a static shooter it wouldnt be.
I still lust and dream about that 500 f4
/sighRumor is the MKIIIn is coming this fall. Should that occur you could probably find moderately used MKIIns at a fraction of what they cost new. All the 1D bodies have shutter lives of 250,000 and even if the shutter count is high, replacing one isnt *that* expensive. Problem is finding a seller you can trust.
Roger that tip about the used MKIIns – appreciate that mucho.
I was a bit irked – had picked up that 17-40 …. Adorama – and now, only a week after I receive mine, Canon offers a $50 rebate on it.
grrrrrr – classic luck for me.

MemberMr. Bennett –
Just a quickie, as I needed to pass this along; I hate you and your MKII.

MemberThanks guys,
For the neophyte buying this equipment, will it be easy to determine U.S. from Gray product? Should I look at the literature, box, or look for some identification on the body/lens?
DustyTwo well-respected online retailers, B&H Photo (http://www.bhphoto.com ) and Adorama ( http://www.adorama.com ) distinguish gray market in their item description.
Er – I think both do – I know at least one does.

MemberJohn,
Excellent, I get that now but actually by just having a few images in the “collection” allows for a potential editor to kinda see your style right?kendal larson
MemberIts sounds like a very slick system w/out a doubt!

MemberKendal,
PS is hooked up with a print company, can’t remember off the top of my head who it is, but what’s cool is that if someone orders a print from your PS gallery, the print company handles the whole deal and you collect the $$$. I did a pricing structure that ensured I’d make a decent profit from the print sale and let them handle all the printing and shipping needs.
Roger that amigo –
I’d actually signed up for PS Archive a couple (or is that few) weeks ago now, and I’m in the process of integrating it into my website, so it appears to be part of my site. You pay a premium price for that functionality, but it’s worth it.
🙂
