    Tennessee and Arkansas both allow you to touch the streambottom to the highwater mark.

    I’ve not researched Tennessee’s law in detail, and this area gets pretty complex and goes back to the early 1800s.  As with a lot of things, many people have strong beliefs on what “the law” is, but it’s not necessarily correct.

    Based on what limited research I’ve done, my impression is that Tennessee only allows you to touch the stream bottom to the high water mark on navigable waters.  Analysis of whether a stream is “navigable” in Tennessee is very complicated, but the main part of the analysis involves whether the stream is large enough for commercial vessels (caveat:
