    My buddy and I, along with two guys from Philly, were arrested tonight for trespass while fishing. We entered via un-posted land and just walked up to our spot and encountered the Philly boys in the stretch we were headed to. We fished near them until some lunatic lady came down and started screaming at us that we had our lines on her half of the stream, but we were standing near the opposite bank. Absolutely ridiculous and the Trooper who did us did not want to listen to anything we had to say. To have a trespass in NY State you must “KNOWINGLY enter or remain unlawfully”. We honestly did not think we were doing anything wrong and it pisses me off to no end that this happened. I am sick.

    The kicker is that when my buddy called me at 3:00 this afternoon I told him I was going to stay home. He called me a pussy, so I had to go…Just before I found out I was a trespasser I did land a gigantic hen that was hooked swinging a small black bugger.

    That’s horrible. Sorry to hear. I think I would be gearing up to fight those charges.

    Nice, huh? There was just no reasoning to be done. This happened at 4:30. The town court we had to go to has court on Mondays at 7:00, so went then. To make a long story short, I talked to the D.A. and he called the town judge and we all got an aquital in comtemplation of dismissal. We were in and out in 10 minutes.

    Zach, I am still wondering the same thing…not that I think I am above the law(I don’t) It doesn’t matter, no one should have been arrested. “Hey guys, Lunatic Lucy don’t want you down there no more. Stay out til we figure out what she owns” would have been sufficient. I am getting more pissed by the minute.

    Paul, I was on Canadaway, about 1 mile up from the lake. I have been walking and fishing that area since I was old enough to ride my bike to get there…30 years.

    We have had a ton of fish for several weeks. I am only 40 minutes from your action. Maybe I will grab a P.A. license this year and head up to check it out. Dop me a line if you ever come down this way. I can certainly tell you where NOT to go 🙂

    One of our patrol guys told me that he was recently sent to a call in which a person was complaining that the neighbors sprinkler was getting her lawn wet.

    Trooper, that is the way it should be handled. I have had people tell me to just stay away from there because she is nuts and will always be a problem. Why should I be restrained from engaging in an activity that I am legally allowed to engage in, on property that I am legally allowed to be on becasue she is a nut and no one wants to deal with her? I know how I would have handled this and no one would have been arrested, except her.

    Poudre, 49% of the homes in the city I work in are 2(+), family slum lord rentals. We get a tremendous amount of noise complaints and the first thing I always ask the complainant is if they asked their neighbor to quiet down. It has never occurred to a single one yet…
